The Film Musicians Secondary Markets Fund maintains a list of individuals that have been credited for theatrical and/or television films but for whom we currently have no address/contact information. These individuals may be entitled to a check.
The Fund, in compliance with legal and fiduciary responsibility, will maintain check status records for up to 7 years (i.e., currently from Fiscal Year 1999 forward). The cut-off year (i.e., the earliest of the 7 year period) will roll forward respectively.
For a period prior to the 7 years, unless the Fund has the records or documentation to conclusively support the status (paid or outstanding) of an original or re-issued check, the Fund reserves the right not to issue a replacement check. The Fund will take the position that unless there is evidence to the contrary, a check, if issued, has been cashed. Fund staff will make every effort to obtain or locate such documentation, but in the absence of any findings may not process a replacement check. This decision will lie solely at the discretion of the Fund Administrator.

Due to the high volume of Unclaimed check requests as well as the Fund’s normal year-end tax obligations, we WILL NOT be able to process requests for Unclaimed Checks received after November 9th, 2007 until after February, 2008 . We will, however, retain all requests received and hold them for processing at the earliest opportunity. We thank you for your patience and understanding and apologize for any inconvenience.
Notice Regarding Escheat Regulations
Please be advised that pursuant to the California Code of Civil Procedure, Section 1521 (“CCP § 1521”), the Film Musicians Secondary Markets Fund qualifies for the “safe harbor” exemption under subsection (b) created for labor unions, and their associated pension/residual/royalty funds that would otherwise apply to unclaimed property and monies.
